MahaRERA Explained — Complete Homebuyer Guide for Pune (2025)

MahaRERA — the Maharashtra Real Estate Regulatory Authority — is the most important consumer protection law for homebuyers in Maharashtra. If you are buying a flat in Pune, Mumbai, or anywhere in Maharashtra, understanding MahaRERA can save you from fraud, project delays, and financial loss. This guide from Guiding Property, a MahaRERA certified consultant (RERA No: A031262401718), explains everything you need to know.

What is MahaRERA?

MahaRERA is Maharashtra’s implementation of the Real Estate (Regulation and Development) Act, 2016 (RERA). It came into force on 1 May 2017 and regulates all real estate projects and agents in the state. The authority is headquartered in Mumbai and operates an online portal at maharera.mahaonline.gov.in.

Key Protections MahaRERA Gives Homebuyers

1. Escrow Account Protection

Builders must deposit 70% of all money collected from buyers into a separate escrow account that can only be used for that specific project’s construction and land costs. This prevents builders from diverting your funds to other projects.

2. Carpet Area Transparency

Under MahaRERA, all sales must be on carpet area basis — the actual usable floor area inside your flat. Builders can no longer sell on “super built-up area” which previously inflated quoted areas by 25–40%. What you buy is what you get.

3. Mandatory Possession Date

Builders must commit to a possession date in the registered agreement. If they miss this date, buyers are entitled to interest at SBI’s Marginal Cost of Funds based Lending Rate (MCLR) + 2% for every month of delay. Repeated delays can be escalated to the MahaRERA tribunal.

4. Structural Defect Warranty

Builders are liable for structural defects for 5 years after possession. If any structural defect appears within this period, the builder must rectify it at no cost to the buyer.

5. No Arbitrary Changes to Plans

Builders cannot make changes to the sanctioned plan without the consent of at least two-thirds of the allottees. This protects buyers from builders reducing amenities or changing layouts after bookings.

How to Verify a MahaRERA Registered Project

  • Visit maharera.mahaonline.gov.in
  • Click on “Registered Projects”
  • Search by project name, location, or promoter name
  • Check the registration number, possession date, and complaint history

Every registered project has a unique MahaRERA number. Always verify this number before paying any booking amount. Guiding Property verifies RERA status for all projects before recommending them to clients.

MahaRERA Agent Registration — Why It Matters

Real estate agents in Maharashtra must also register with MahaRERA. An unregistered agent cannot legally facilitate a property transaction. Always verify your agent’s RERA number before engaging them.

Guiding Property is MahaRERA registered with Agent Registration No: A031262401718. You can verify this directly at maharera.mahaonline.gov.in under “Registered Agents.”

How to File a Complaint Under MahaRERA

If a builder violates RERA provisions, you can file a complaint online at maharera.mahaonline.gov.in. The MahaRERA adjudicating officer must resolve disputes within 60 days. Penalties on builders can include:

  • Penalty up to 5% of the project cost for non-compliance
  • Imprisonment up to 3 years for repeat violations
  • Cancellation of project registration
